1. Acceptance of Terms
By downloading, installing, accessing, or using Hourd ("the App"), you ("User" or "you") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not download, install, or use the App.
These Terms constitute a binding legal agreement between you and Abdukhalik Magomedov ("we," "us," or "our").
2. Description of Service
Hourd is an iOS application designed to help users make informed purchasing decisions by calculating the time cost of purchases based on their hourly wage. The App provides:
App Features (Subscription Required)

Time cost calculations based on hourly wage
Purchase decision tracking (Buy/Don't Buy)
Savings analytics and insights
Multiple currency support
Purchase history and trends
Home screen and lock screen widgets
Advanced analytics and reporting
All calculation and tracking functionality

Important: All app functionality requires an active subscription after the free trial period.
3. User Accounts and Registration
Hourd does not require user account creation. All data is stored locally on your device. By using the App, you acknowledge that:

You are responsible for the accuracy of wage and financial information you input
You will use the App in compliance with these Terms
You are at least 13 years of age (or the minimum age in your jurisdiction)

4. Subscription and Payment TermsRequired Subscription
IMPORTANT: All app functionality requires an active subscription after the free trial period. The app will not function without a valid subscription.
3-Day Free Trial

New users receive a 3-day free trial with full access to all app features
Trial includes: Complete access to time cost calculations, purchase tracking, widgets, analytics, and all functionality
Trial period begins: Immediately upon first app launch for eligible users
No charges during trial: You will not be charged during the 3-day trial period
Trial eligibility: Limited to new users who have never subscribed to Hourd
Trial cancellation: You may cancel anytime during the 3-day trial period to avoid any charges

Automatic Trial Conversion

Automatic billing: If you do not cancel before the trial ends, you will be automatically charged for your selected subscription (monthly or annual)
Payment method: Payment will be charged to your iTunes Account at the end of the 3-day trial period
No partial refunds: Any unused portion of the free trial period will be forfeited if you purchase a subscription before the trial ends

Subscription Options and Billing

Monthly subscription: Billed monthly after the 3-day free trial period ends
Annual subscription: Billed yearly after the 3-day free trial period ends, typically at a discounted rate compared to monthly billing
Automatic renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Renewal charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
Subscription management: Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase
No mid-period cancellation: No cancellation of the current subscription is allowed during the active subscription period

Pricing and Billing Details

Pricing display: Monthly and annual subscription pricing is displayed in the App and App Store
Currency conversion: Prices may vary by location and are converted to your local currency
Price changes: Prices are subject to change with advance notice to existing subscribers
Payment processing: All payments are processed through Apple's iTunes billing system
Non-refundable: All fees are non-refundable except as required by applicable law or Apple's standard refund policy

Free Trial Cancellation

Cancel anytime: You may cancel your free trial at any time during the 3-day period without being charged
How to cancel: Cancel through iTunes Account Settings before the trial period ends
Automatic conversion: If you do not cancel before the 3-day trial period ends, your trial will automatically convert to your selected subscription (monthly or annual)
No refunds after conversion: Once the trial converts to a paid subscription, standard cancellation terms apply

Subscription Cancellation and Refunds

Cancellation method: You may cancel your subscription anytime through iTunes Account Settings
When cancellation takes effect: Cancellation takes effect at the end of your current billing period
App functionality after cancellation: The app will become non-functional when your subscription expires - you will lose access to all features
No partial refunds: No refunds will be provided for partial subscription periods
Apple refund policy: Refunds are handled exclusively by Apple according to their standard refund policy
Refund requests: To request a refund, contact Apple Support directly through the App Store

5. Privacy and Data Protection
Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our privacy practices as described in our Privacy Policy.
Data We Collect

Purchase amounts and decision history (Buy/Don't Buy)
Currency preferences and hourly wage settings
Basic app usage patterns for functionality improvement
Device information necessary for app operation
Crash reports and technical data for app stability

How We Use Your Data

Calculate time costs based on your wage settings
Track your savings and provide personalized analytics
Improve app performance and user experience
Process subscription payments through Apple and third-party payment processors
Provide customer support when requested

Data Sharing and Third Parties

Payment processing is handled by Apple App Store and may involve third-party services
We do not sell your personal data to third parties
Anonymous, aggregated analytics may be shared with service providers to improve the App
We may share data when required by law or to protect our legal rights

6. Permitted and Prohibited UsesPermitted Uses
You may use Hourd for:

Personal financial decision-making and budgeting
Calculating time costs of purchases

Prohibited Uses
You may not:

Use the App for any unlawful purpose or in violation of these Terms
Attempt to reverse engineer, decompile, or disassemble the App
Use the App to provide financial advice to others commercially
Share, distribute, or resell your subscription access
Attempt to circumvent subscription requirements or payment systems
Use the App in any way that could damage, disable, or impair the service
Upload viruses or other malicious code
Collect or harvest any information from the App or other users
Use automated systems to access the App

7. Intellectual Property RightsOur Rights
Hourd and all related intellectual property rights, including copyrights, trademarks, trade secrets, patents, and proprietary algorithms, are owned exclusively by us or our licensors.
License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Hourd solely for your personal, non-commercial purposes.
Restrictions
You may not:

Copy, modify, distribute, sell, or lease any part of the App
Create derivative works based on the App
Use our trademarks or branding without written permission
Remove or alter any proprietary notices in the App

Third-Party Claims
We will defend you against any third-party claim that the App infringes any patent, copyright, or trademark, provided you notify us promptly of such claim.

IMPORTANT: Hourd is a calculation tool designed to help you visualize the time cost of purchases. It is NOT intended to provide financial, investment, tax, legal, or accounting advice.

All purchase decisions remain entirely your responsibility
Calculations are based on information you provide and may not reflect your complete financial situation
The App should not be your sole basis for financial decisions
Consult qualified financial professionals for personalized advice
We make no guarantees about financial outcomes from using the App

Exchange Rate Disclaimer

Currency exchange rates provided are approximate and for calculation purposes only
Rates are updated regularly but may not reflect real-time market conditions
Exchange rates are obtained from third-party sources and we cannot guarantee their accuracy
For actual currency transactions, verify current rates with financial institutions
We are not responsible for any losses due to exchange rate fluctuations or inaccuracies

Calculation Accuracy

All calculations depend on the accuracy of wage and cost information you provide
The App performs mathematical calculations based on your inputs
We do not verify the accuracy of information you enter
Results are estimates and should be verified independently for important decisions
Small rounding differences may occur in complex calculations

Service Availability

The App is provided "as is" and "as available"
Service may be interrupted for maintenance, updates, or technical issues
We may modify, suspend, or discontinue features with reasonable notice
Not all features may be available in all regions
Performance may vary based on device capabilities and network connectivity

9. Warranty Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

MERCHANTABILITY: No warranty that the App will meet your specific needs
FITNESS FOR A PARTICULAR PURPOSE: No warranty for any specific use case
NON-INFRINGEMENT: No warranty against third-party intellectual property claims
ACCURACY: No warranty regarding calculation accuracy or exchange rate precision
UNINTERRUPTED SERVICE: No guarantee of continuous availability

Additional Disclaimers

We do not warrant that the App will be error-free or virus-free
We do not warrant that defects will be corrected
We do not warrant compatibility with future iOS versions
Any advice or information obtained through the App does not create warranties

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Damages Excluded
WE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Financial losses resulting from purchase decisions made using the App
Damages arising from exchange rate fluctuations or inaccuracies
Harm resulting from reliance on App calculations for major financial decisions

Maximum Liability Cap
Our total liability for all claims arising from your use of the App shall not exceed the total amount you paid for App subscriptions in the 12 months preceding the claim.
Essential Purpose
These limitations apply even if our limited remedies fail of their essential purpose.
11. Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, and licensors from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Any financial decisions made based on App calculations
Any content or information you input into the App
Your violation of any applicable laws or regulations

12. TerminationTermination by You

You may stop using the App at any time by deleting it from your device
You may cancel your subscription through iTunes Account Settings
Cancellation does not entitle you to a refund for the current billing period

Termination by Us
We may terminate or suspend your access to the App immediately if you:

Violate these Terms
Engage in fraudulent or illegal activities
Abuse our support services
Attempt to circumvent payment systems
Fail to maintain an active subscription (app will become non-functional)

Effect of Termination
Upon termination or subscription expiration:

Your right to use the App ceases immediately
All app functionality becomes unavailable
You must delete the App from your devices if requested
Locally stored data may remain until you delete the App
Provisions regarding liability, indemnification, and dispute resolution survive termination

13. Apple App Store TermsThird-Party Beneficiary
Apple Inc. is a third-party beneficiary of these Terms and has the right to enforce these Terms against you.
Apple's Responsibilities

Apple is not responsible for the App, its content, maintenance, or support
Apple has no obligation to furnish any maintenance or support services
Apple is not responsible for addressing any claims relating to the App
In the event of any third-party claim that the App infringes intellectual property rights, we (not Apple) will be responsible for investigation and defense

Apple Warranty and Liability

In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price
To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App
Apple is not liable for any other claims, losses, liabilities, damages, costs, or expenses related to the App

Export Control
You represent and warrant that:

You are not located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country
You are not listed on any U.S. Government list of prohibited or restricted parties

14. Governing Law and Dispute ResolutionGoverning Law
These Terms are governed by and construed in accordance with the laws of Georgia, without regard to conflict of law principles.
Dispute Resolution Process
Step 1 - Direct Resolution: Before initiating any legal proceedings, you agree to contact us directly at pand0ra_Q@hotmail.com to attempt to resolve the dispute informally.
Step 2 - Binding Arbitration: If direct resolution fails, any dispute arising from these Terms will be resolved through binding arbitration administered by [ARBITRATION SERVICE] under their rules.
Arbitration Terms

Arbitration will be conducted in Tbilisi, Georgia
The arbitration will be conducted by a single arbitrator
The arbitrator's decision will be final and binding
Each party bears their own costs and fees
Small claims court disputes under $10 are excluded from mandatory arbitration

Class Action Waiver
You agree that any arbitration or legal proceeding will be conducted only on an individual basis and not as a class action, collective action, or representative proceeding.
Judicial Jurisdiction
For disputes not subject to arbitration, the exclusive jurisdiction and venue will be the state and federal courts located in Tbilisi, Georgia, and you consent to personal jurisdiction in these courts.
15. Changes to These TermsModification Rights
We reserve the right to modify these Terms at any time. When we make changes:

We will update the "Last Updated" date at the top of these Terms
Material changes will be communicated through the App or email (if we have your email)
Changes become effective immediately upon posting unless otherwise specified

Notification of Changes
For significant changes that materially affect your rights, we will:

Provide at least 30 days advance notice
Notify you through the App interface
Send email notification if we have your contact information
Post updates on our website (if applicable)

Acceptance of Changes
Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the App and cancel your subscription.
16. General ProvisionsEntire Agreement
These Terms, together with our Privacy Policy and any additional terms presented to you within the App, constitute the complete agreement between you and us regarding the App and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be replaced with a valid provision that most closely reflects the original intent.
No Waiver
Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision. No waiver will be effective unless made in writing and signed by our authorized representative.
Assignment

You may not assign, transfer, or sublicense these Terms or your rights under these Terms without our written consent
We may assign these Terms and all rights and obligations hereunder to any third party without restriction
These Terms bind and benefit the parties and their respective successors and assigns

Force Majeure
We will not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, strikes, internet failures, or government actions.
Survival
Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity obligations, limitations of liability, and dispute resolution provisions.
Language
These Terms are written in English. Any translations provided are for convenience only, and the English version will control in case of conflicts.
