PottyDog — Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the PottyDog mobile and watch applications, widgets, and related software (collectively, the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
References to “we,” “us,” or “our” mean the PottyDog team, as the provider of the App.
In addition to these Terms, your use of the App is also subject to Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”), which applies by default to all App Store apps. If there is a conflict, the Apple Standard EULA controls to the extent it is required by Apple. See: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
1) Eligibility
- You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age of majority, you must have permission from a parent or legal guardian.
2) Description of the Service
- PottyDog helps households track a dog’s walks and bathroom events with simple logging on iPhone and Apple Watch, and shows recent activity via widgets and complications.
- PottyDog is private by design. Data is stored on your devices and in your personal iCloud account using Apple CloudKit. We do not run our own servers for your dog data.
- You can optionally share a dog’s data with co‑parents via Apple CloudKit sharing.
3) Accounts, Apple ID, and iCloud
- The App does not require an in‑app account. It relies on your Apple ID and iCloud to sync data across devices.
- You are responsible for maintaining sufficient iCloud storage and stable connectivity. We are not responsible for iCloud outages, Apple service limitations, or data unavailability caused by iCloud issues.
- If you sign out of iCloud, disable iCloud Drive, or delete iCloud data, some or all App features will not function and data may become unavailable.
4) In‑App Purchases and Subscriptions
Some features may require a one‑time purchase or a subscription sold through Apple’s in‑app purchase system and managed by RevenueCat.
- Billing: Payment is charged to your Apple ID at purchase confirmation.
- Auto‑renewal (if you buy a subscription): Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Your Apple ID is charged for renewal within 24 hours before the end of the current period.
- Manage or cancel: You can manage or cancel subscriptions in your App Store account settings after purchase. We cannot cancel for you.
- Free trials (if offered): Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds: All sales are final. Refunds are handled by Apple according to App Store policies. We cannot issue refunds directly.
- Changes: Offerings, pricing, and features may change at any time. If pricing changes for a subscription, Apple may notify you and you can cancel before renewal.
5) Sharing via CloudKit
- You may invite others to view or log a shared dog. Invitations and access are handled through Apple’s CloudKit sharing. You control who can access your shared data.
- Removing a participant or revoking a share immediately limits their access. We do not mediate disputes between sharers.
6) User Content and Acceptable Use
- You are responsible for content you log (e.g., dog names, notes) and for ensuring you have rights to share it.
- Do not upload content that is illegal, infringing, defamatory, obscene, or that violates any third‑party rights or laws.
- Do not misuse the App (e.g., interfere with its operation, reverse engineer, attempt unauthorized access, or use it to build a competing service).
7) Health/Veterinary Disclaimer
- PottyDog is for routine tracking and convenience only. It does not provide veterinary advice, diagnostics, or treatment. Always consult a qualified veterinarian for medical concerns about your pet.
8) Privacy
- We aim to minimize data collection. Dog activity data is stored on device and in your personal iCloud. We may collect limited technical or purchase metadata needed to operate the App (e.g., via RevenueCat for purchase validation).
- Your use of the App is also subject to our Privacy Policy, which explains what data we process and your choices. Privacy Policy: available via the App Store listing or our website.
9) Third‑Party Services
- Apple: The App relies on Apple services (iCloud, CloudKit, Apple Watch, App Store). Those services are provided “as is” by Apple and outside our control.
- RevenueCat: We use RevenueCat to help manage in‑app purchases and subscriptions. RevenueCat may process limited device and transaction metadata to fulfill purchases. See RevenueCat’s documentation and privacy disclosures for details.
10) Apple’s Role and EULA
- You acknowledge that Apple is not responsible for the App or its content, maintenance, or support.
- Apple has no obligation to furnish any maintenance or support services for the App.
- Your license to use the App is subject to the Apple Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if applicable) to you; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
11) Notifications
- The App may request notification permissions so your devices can stay in sync via CloudKit. We do not send promotional notifications. Silent notifications may be used for background updates.
12) Intellectual Property
- The App, including its design, text, graphics, logos, and code, is owned by us or our licensors and is protected by intellectual property laws. You receive a personal, limited, revocable, non‑transferable license to use the App under these Terms and the Apple Standard EULA.
13) Feedback
- If you send suggestions, you grant us a non‑exclusive, worldwide, royalty‑free license to use them without obligation.
14) Disclaimers
- THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DATA WILL ALWAYS BE AVAILABLE THROUGH ICLOUD.
15) Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP OR THE SUBSCRIPTION PERIOD DURING WHICH THE CLAIM AROSE.
16) Indemnification
- You will defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the App or violation of these Terms.
17) Termination
- You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if continued operation of the App becomes impractical due to legal or technical reasons. Upon termination, your license ends and you must stop using the App. Your personal iCloud data remains in your Apple account unless you delete it.
18) Data Retention and Deletion
- Because your dog data lives in your iCloud account, you control retention. You can delete entries or dogs inside the App, or delete the App’s data from iCloud using iOS settings. Deleting the App does not automatically remove iCloud data.
19) Changes to the App and to These Terms
- We may update the App and these Terms from time to time. If changes are material, we will provide notice (e.g., in‑app notice or version notes). Continued use after changes become effective constitutes acceptance of the updated Terms.
20) Governing Law; Venue
- These Terms are governed by and construed in accordance with the laws of Georgia, without regard to conflict‑of‑law principles.
- Informal resolution first: Before initiating any legal proceedings, you agree to contact us to attempt to resolve the dispute informally.
- For disputes not subject to small‑claims court, the exclusive jurisdiction and venue will be the courts located in Tbilisi, Georgia, and you consent to personal jurisdiction in these courts.
- Class action waiver: Any dispute will be conducted only on an individual basis and not as a class, collective, or representative proceeding, to the extent permitted by applicable law.
21) Export and Sanctions
- You may not use or export the App in violation of U.S. export laws or other applicable export and sanctions regulations.
22) Miscellaneous
- Entire agreement: These Terms and the Apple Standard EULA constitute the entire agreement between you and us regarding the App.
- Severability: If any provision is found unenforceable, the remainder will remain in effect.
- Assignment: You may not assign your rights under these Terms. We may assign in connection with a merger, sale, or reorganization.
